At KT Sound we offer the voice-over learning and knowledge training that involves the experts knowledge, explains the theory, encourages practice, and provides many opportunities to gain real-life skills and abilities. We work where talents turn knowledge and skills into habits that support their professional career. We believe that voice-over learning should also support talent's voice-over business objectives and therefore we enable them to learn from industry experts and contribute by sharing and learning from one another. Our learning microsites were designed to make it easy to navigate, learn and get feedback whenever it is most convenient for the learner. Unlike an average voice-over course that only gets little usage we provide unique learning with dynamic exercises and numerous opportunities to give learners a head start and achieve better results faster. There are many voice-over courses available on the market, but we believe that this is probably the only voice-over training you will ever need. KT Sound is also the first voice-over training in the world to introduce VR 3D world to teach voice-over in the 2023 intake. 

These Terms and Conditions offer crucial insights into the KT Sound training program, its policies, and user expectations. The structure is designed to facilitate your access to various components and ensure your understanding of the terms and conditions prior to your purchase of the training. 

To protect you and the training author, the training itself, the training website, including its microsites and 3D virtual environment, please read carefully the "Terms and Conditions" of the KT Sound training. You are required to fully understand and accept the terms and conditions before buying the training, in particular the "Technical Requirements", "No refund policy", and the "Disclaimer", or reject the terms and conditions and refrain from buying it. By using our website and the KT Sound training, you confirm that you are 18 years of age or older and have read and agreed to the "Terms and Conditions", otherwise you are not entitled to buy, access, download training resources, and use the KT SOUND training.

1. Introduction

1.1 By using the KT Sound training, website, its microsites, accessing resources, an online community server, or by clicking to accept or agree to the Terms and Conditions, Privacy Policy or Cookie Policy when this option is made available to you, you accept and agree to be bound and abide by our Terms and Conditions, Privacy Policy or Cookie Policy. This also includes the situation when accessing external service providers we use to deliver and / provide our services, in this case you accept the additional Community Guidelines, Terms and Conditions, Privacy Policy and Licences required by external providers and agree to be bound and abide by them. These will vary from service to service and will require you to accept them before accessing the service.

1.3 The information on this Website and the resources available for download through the training microsites are for educational and informational purposes only. 

1.4 The expression "the Supplier", or "we" means Kamil Tomzik (voice-over artist, trainer, certificated voice-over training provider), or Kamil Tomzik Sound of www.kamiltomziksound.com, www.kamiltomzik.com, and www.thevoiceacting.com which, are registered trading names and, domains of Creative Solutions Scotland. The expression "the client", "or client" means the person, firm, company or entity purchasing, or listing on third party websites with the intent of buying goods or services from the supplier. 

1.5 The Supplier contracts on these conditions only and acceptance by the Supplier of any order from a client will be deemed an acceptance of these Terms and Conditions by the client. No Terms and Conditions other than those set forth herein or any variation thereof under Condition 19 shall be binding upon the Supplier or the client unless provided in writing and signed by or on behalf of both the Supplier and the client.

1.6 Kamil Tomzik Sound takes copyright infringement seriously. Portions of material on our websites and systems we use are user-submitted. By using our services you agree that copyrighted materials were created by you (e.g., assignments, photos, audio files), if they are the third party must not be submitted without permission from the copyright holder unless they have MIT, Creative Commons, or any other Open Source compatible licence allowing publication with providing the source of information that in most cases is the web address and the author's name / nickname (in this case please read the licence before submitting / sharing information). When publishing digital content you confirm that you have the right to do so.

1.7 Anyone distributing copyrighted material without authorisation is an infringer. Kamil Tomzik Sound may take appropriate measures to terminate, ban and/or restrict the access of infringers to the Kamil Tomzik Sound Voice-Over Training, Microsites, Online Community, or other information. In the event of an infringement, Kamil Tomzik Sound may contact the appropriate authorities and file legal action to prevent future infringements and recover damages.

1.8 All materials contained on and generated by this website, Voice-Over Training, its Microsites and Online Community except these belonging to another party are copyrighted. All rights reserved. No person is authorized to use, copy or distribute any portion of the Web Site or Kamil Tomzik Sound products including, but not limited to files, games' ideas, exercises, activities, training materials, certificates, digital badges and others. “Kamil Tomzik Sound” and other trademarks and/or service marks (including logos and designs) found on the Web Site are trademarks/service marks that identify the Web Site and the goods and/or services provided by Kamil Tomzik Sound through the Web Site. Such marks may not be used under any circumstances without prior written authorisation.

2. Payments

2.1 Payment can be done via PayPal, which supports PayPal payment, Debit, or Credit Card payment and is available on our website under the Payments site. We employ Stripe Payments as an additional payment gateway, and their usage depends on the specific landing page.

2.1.1 Our clients are located worldwide, therefore we use PayPal, and Stripe which are fast and safe way to send money and make online payments.

2.1.2 We do not have access to or keep any credit card information or your bank account information. We use PayPal and Stripe, industry leaders on payment processing to handle the payments. Both payment gateways keeps the payment information safe and will use it to handle the payments.

2.2 All details will be provided with the invoice, or send by email when requested by the client.

2.3 Payments for work or services are accepted in currencies that are compatible with PayPal, or Stripe (depending on the landing page) and will be converted to GBP automatically.

2.3.1 Payment for online training, and access to Standard, or Gold Talent Area and any other additional digital goods and modules is conducted in fast and secure manner and will be actioned up to 24 hours after the payment.

2.3.2 Payment for online voice-over training is due instantly and for in person voice-over recording sessions instantly or after the recording session not longer than within 30 days of the date of the invoice (unless otherwise specified).

2.3.2 Payment for voice-over recording sessions is due not longer than within 14 days of the date of the invoice (unless otherwise specified).

2.4 In accordance with the Late Payment of Commercial Debts (Interest) Act 1998, as amended and supplemented by the Late Payment of Commercial Debts Regulations 2002 (EC Directive), the right is reserved to charge interest at 8% above the late payment period reference interest rate based on the relevant Bank of Scotland base rate on all amounts outstanding for more than 30 days (the Credit Period) from the Issue Date indicated on the invoice; and further to make a statutory compensatory charge on late payments, as follows: for amounts up to £999.99 a charge of £40; for amounts between £1,000 and £9,999.99 a charge of £70; and for amounts of £10,000 and above a charge of £100. Such charges may be applied and added to the debt. Details of these charges can be found at www.payontime.co.uk/legislation/legislation_main.html.

2.5 The right is reserved to levy a minimum charge of £10 for each written / emailed reminder or statement produced and sent after the Credit Period.

2.6 Credit facilities and the supply of any future services may be withdrawn in the event of a breach of these Terms and Conditions.

2.7 For voice-over recording sessions unless otherwise agreed, all Session and Usage fees are set at no lower than the minimum relevant Equity rates, together with any additional Terms and Conditions or guidelines in force at the time the service was provided. Equity is a union of more than 47,000 performers and creative practitioners, united in the fight for fair terms and conditions in the workplace. Equity has produced a guide, where it recommends daily performance salary in the UK. 

2.8 For voice-over recording sessions Daily Performance Salary must be at least the minimum wage hourly rate, as defined in the National Minimum Wage Act 1998 or any modification or re-enactment thereof. It is recommended by Equity that the Artist is paid a minimum Daily Performance Salary or a minimum Weekly Performance Salary (five-day week) equivalent to the minimum basic rates with all applicable expenses, as set out below:

2.9 For voice-over recording sessions a minimum project fee for voice-over is £35.00. There may be additional production costs for projects involving:

2.10 Any such charge(s) will be notified to the client in advance.

2.11 For voice-over recording sessions fees for voice-overs supplied for radio commercials produced by a radio station or appointed sub-contractor are calculated on a one fee per voice performed, per script, per station basis at the relevant transmitting station(s) rates unless otherwise indicated.

2.12 We do not accept payments in cryptocurrencies.


3. Cancellations & Refusal to Serve Clients Right

3.1 Voice-over contracts:

3.1.1 If the client cancels any contract giving the Supplier less than twenty-four hours' notice, the Supplier reserves the right to charge a cancellation fee of 100% of the fees payable under the terms of the contract.

3.1.2 If the client cancels any contract giving the Supplier more than twenty-four hours' notice, the Supplier reserves the right to accept other contracts to fill in the time and return agreed fee in full (in unlikely situations if paid before the work was started. Usually the payment is made after the work was delivered).

3.2 Training and Certificates:

3.2.1 No cancellation is possible, except situations that may occur in paragraph 8. Failure to Comply and paragraph 12. Termination. Please see the no refund policy for more details regarding refunds.

3.3.1 Our right to refuse the service (Voice-Over, Online Training, DJ, Other).

3.3.2 We, like any other business in the UK, reserve the right to reject service to anyone, but especially when we believe that:

4. Ownership & Copyright License

4.1 The Supplier is serious about using only licenced audio, or video material in their work and will never intentionally use unlicensed audio or video in their recordings.

4.2 Copyright in all audible and/or written material created by the Supplier remains the property of the Supplier unless the client and Supplier have agreed otherwise by way of a written contract.

4.3 Copyright in all audible / video and / or written material provided by the client remains the property of the client unless the client and Supplier have agreed otherwise by way of a written contract.

4.4 The client undertakes that they will notify the Supplier if they shall assign, transfer or sell any Contract or benefit to which these Terms and Conditions apply.

4.5 The client warrants and undertakes that: 

4.6 The copyright in the main website, as well as Standard and Gold Ambassador Talent Area microsites and the material on those websites (including without limitation the text, computer code, artwork, photographs, images, music, audio material, video material and audio-visual material on this website), is owned by Kamil Tomzik Sound, but also by its respective owners and its licensors. Be aware, that some material we use is in the domain of the public under Creative Commons, MIT license and other licences including books, information, photos, source code to games and exercises and we do not claim any rights to those resources. These Open-Source resources are available for free with the right to use for commercial purposes and belong to their respective owners. We do not hold any rights and do not act on behalf of their authors.

4.7 We work hard to support all creators and credit all sources and creators with the open-source content we used to develop this training. If you created and shared for free any work that we used e.g., source code, sounds, graphics, photos and you think that your name should be mentioned please let us know about it.

4.8 On our website we also share hyperlinks to external websites. Those websites and the software used within their source code belongs to their respective owners and we do not hold any rights and do not act on their behalf. 

4.9 Kamil Tomzik Sound grants to you a worldwide non-exclusive royalty-free revocable license to:

4.12 Every few months we conduct a deep search using specialised tools online and look for our resources, texts, activities on the internet including video services, voice-over courses including personal websites, social media groups, masterclasses online, available to the public events booking systems, and other websites not listed here for materials used in our certified voice-over training course. If we find that the content, videos, files, or ideas that we have developed and used in our certified training course including those stored in the Standard, or Gold Talent Area of any of the Voice-Over Modules have been unlawfully downloaded, sold, shared, or republished on any other website / group / server / platform / training provider / administrator, user, individual or are being used without our permission, what interferes with our rights, we will contact website / group / server / platform / training provider / administrator / user / individual and take legal actions.

4.13 Do not attempt to reverse-engineer any of our websites (including 3D VR Studio), or source code. You do not have permission to access Standard and Gold Ambassador Talent Area microsites without issuing the payment. Any attempt to hack our main site or one of micro sites may be reported to the relevant authorities and may result in contacting website / group / server / internet provider / platform / training provider / administrator / user / individual / and taking legal actions.

4.14 All Kamil Tomzik Sound Voice-Over Training content appearing on the www.kamiltomziksound.com, www.kamiltomzik.com, and www.thevoiceacting.com website address, leading to the same website, or its microsites is protected by copyright under UK copyright laws and is the property of www.kamiltomziksound.com or the party credited as the provider of the content - Kamil Tomzik. You may not copy, reproduce, distribute, publish, display, perform, modify, create derivative works, transmit, or in any way exploit any such content, nor may you distribute any part of this content over any network, including social media, email, messenger, chat online, a local area network, sell or offer it for sale, or use such content to construct any kind of database, website, or training. You may not alter or remove any copyright or other notice from copies of the content on www.kamiltomziksound.com website, or its microsites. 4.17 The Kamil Tomzik Sound training is in no way sponsored, endorsed, administered by, or associated with any social media providers, networking sites, voice-over companies, or any other companies, or businesses that have been mentioned on the training, or any of the training websites, including www.kamiltomziksound.com, www.kamiltomzik.com, and www.thevoiceacting.com. 

4.18 All logos and brands belong to their respective owners, and they were used only as an example. All music, graphics and photographs belong to their creators, except for those that belong to Kamil Tomzik Sound. Social media logos belong to their respective owners, and they were also used only as an example.


5. Unfair competition

5.1 Unfair competition is defined as conduct in trade or commerce by a market participant that gains or seeks to gain an advantage over its competitors through misleading, deceptive, dishonest, fraudulent, coercive, or unconscionable conduct.

5.2 Unfair competition can refer to any of various distinct areas of law that may give rise to distinct criminal offences and civil claims:

5.2.2 Unfair business practices such as fraud, misrepresentation, tortious interference with an existing contractual relationship, tortious interference with a prospective business relationships, and unconscionable contracts and business practices.

5.2.4 Misappropriation of trade secrets. In the United States, this type of activity is prohibited by the Uniform Trade Secrets Act and the Economic Espionage Act of 1996.

5.2.5 Intentional violation of the terms and conditions.

5.2.6 Acting with the intention of creating an unfair competition.

5.3 Certain acts are prohibited under the Paris Convention, including false allegations discrediting a competitor and indications or allegations in the course of trade that is likely to mislead the public as to the nature, manufacturing process, characteristics, suitability for their purpose, or quantity of the goods. The Paris Convention has now been signed by over 170 countries.

5.4 Kamil Tomzik Sound will not tolerate unfair competition, unfair business practices, anti-competitive behaviour or any other illegal and / or damaging practices e.g., fake profiles, emails, or names during registration process, or communication with our staff in both email and social media communication. All incidents classified as unfair competition will be reported to the relevant bodies and, depending on seriousness, may also lead to legal action.

5.5 By using our services, joining voice-over training and accessing an online community server, you confirm that you agree that any deliberate omission, wrongdoing, false allegations, falsification, illegal or dishonest behaviour or misrepresentation in the payment forms, questioneers, communication, social group, or online community server will be grounds for rejecting you from the training and no monies will be refunded. All incidents classified as unfair competition will be reported to the relevant bodies and, depending on seriousness, may also lead to legal action.

5.6 While developing KT Sound training, we did our utmost to provide the best original training content with the option to continue your learning in the other modules. However, if you decide to harm our brand, good name, or report websites, training, or people involved in the training development by complaining to the internet service provider, server provider, service providers, external businesses, or local authorities for misconduct, wrongdoing, scam, or make other allegations without merit, be prepared, because we may take legal action against you. This includes reporting KT Sound using allegations without merit, reporting our website, microsites or business, overly aggressive correspondence, threatening correspondence, excessive correspondence, misleading correspondence, and similar. 6. Trademarks

6.1 Name "Kamil Tomzik Sound" is registered with the Intellectual Property Office in the UK with the Trade Mark Number in Class 41: Training courses; Providing courses of training; Provision of training courses; Organisation of training courses; Arranging of training courses; Providing of continuous training courses; Training; Training and further training consultancy; Training services; Provision of education courses; Voice training; Training consultancy; Advanced training. 

6.2 The Intellectual Property Office of the United Kingdom is, since 2 April 2007, the operating name of The Patent Office. It is the official government body responsible for intellectual property rights in the UK and is an executive agency of the Department for Business, Energy and Industrial Strategy.

6.3 Because our brand is registered with the Intellectual Property Office of the United Kingdom we can:

7.1 Training and certificate prices are quoted net of Value Added Tax (if applicable and unless specifically indicated otherwise) which will be payable at the appropriate rate. (Note: No need for VAT, as the Supplier is not VAT registered.)

7.2 We are entitled to vary the price to take account of:

8. Failure to Comply

8.1 In the event of any failure by the client to comply with these Terms and Conditions, the Supplier may terminate immediately any licence to the client to use, access, broadcast or perform or otherwise exploit the Supplier's work. For more information please visit paragraph 12.

8.2 Kamil Tomzik Sound holds the right to revoke the access to the training, Digital Badges and awarded Certificates to those, who fail to comply with these Terms and Conditions.

8.3 All copyright breach incidents will be reported to the relevant bodies.


9. Governing Laws

9.1 If any provision of these Terms and Conditions is held by any court or competent authority as invalid or unenforceable in whole or in part the validity of the remainder of these Terms and Conditions and of the remainder of the provisions in question shall not be affected.

9.2 The Contract shall be governed by and construed in accordance with the laws of Scotland and the parties hereby submit to the jurisdiction of the Scottish Courts.

9.3 All voice-over and voice acting projects voiced by Kamil Tomzik / www.kamiltomziksound.com, www.kamiltomzik.com, and www.thevoiceacting.com are subject to the Terms and Conditions stated on this site when contracted to the project and are bound by Scottish Law.

9.4 We work with a variety of voice-over and voice talent companies and comply with their Terms and Conditions.


10. Right to Change

10.1 Kamil Tomzik Audio reserve the right to make any changes to the Terms and Conditions at any time without notice but will uphold all previously agreed terms and conditions with the existing clients. Any changes will be communicated to existing clients in writing e.g., via email.


11. Interaction with the Client and the Recording Restrictions

11.1 Kamil Tomzik Sound will never intentionally record offensive music, voice-over, training (bear in mind that some music may have offensive lyrics) or offend anyone in its audio recordings, so no sectarian songs, chants, football songs, or any otherwise offensive or unsuitable songs will be used, even if requested by the client. 

11.2 The sectarian or other meanings of song, like almost all cultural performances, depends to a great extent upon the context. The client should discuss this with the Supplier before the booking or buying services. 

11.3 Kamil Tomzik Sound will not enter into any debate regarding this and will not repeat, tell, or tolerate any jokes or co-called small talk, chat, or banter relating to sectarianism, xenophobia, hate, threats, verbal abuse, violence, person’s colour, race, nationality, citizenship, ethnic or national origins, religious belief, sexual orientation or disability. 

11.4 Any work showing those signed will not be accepted. Any extreme forms of unacceptable, or dangerous behaviour from the client may be reported to the relevant bodies for further action.

11.5 If Kamil Tomzik Sound staff will be threatened by anyone before, during, or after the engagement, or contract duration with any of mentioned in paragraph 10.3 behaviours, we have the right to refer to paragraph 11 and terminate the contract with immediate effect. In that case, no monies will be refunded.


12. Termination

12.1 In case of receiving or experiencing unacceptable behaviours, or any form of threatening communication from the client we have the right to terminate the contract with immediate effect. In that case, no monies will be refunded.

12.2 The Agreement shall continue until the Services have been provided or any subsequent date as mutually agreed in writing by both parties or until terminated by either party in accordance with these Terms and Conditions.

12.3 We may terminate the Agreement if the client has failed to make over any payment due within 90 days of the sum being requested, or accessed the voice-over training without prior payment.

12.4 We may terminate the Agreement if the client repeatedly exceeds the daily download quota.

12.5 Either party may terminate the Agreement by notice in writing to the other if:

12.6 If termination occurs, the client is responsible for settling any payments related to work completed and expenses accrued up until the termination date. 

12.7 Any rights to terminate the Agreement shall be without prejudice to any other accrued rights and liabilities of the parties arising in any way out of the Agreement as at the date of termination.


13. Limitation of Liability

13.1 The Kamil Tomzik Sound will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website, incorporated scripts, exercises, or the audio service:

13.2 As mentioned in paragraph 13.1 we cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits, to you howsoever arising. 

13.3 We shall not be held liable for any failure or delay in performing the services where such failure arises as a result of any event of Force Majeure. These may include but are not limited to traffic delays, breakdown of our vehicles when going to the recording studio, sickness, equipment failure, website failure, microsites failure. We have a backup plan but in some cases, it may be limited to major events like electricity failure, natural disasters or the outbreak of hostilities. (We have never had any of these issues and we have never let a client down).

13.4 We shall not be liable for any misrepresentations, an untrue or misleading statement of fact made during negotiations by one party to another, where the statement then inducing that other party to enter into a contract.

13.5 We shall not be liable for any misrepresentations, an untrue or misleading statement of fact made during voice-over recording. We assume that all provided by the client material / scripts were checked, are legal and safe to use. This is the client responsibility.

13.6 Because the sectarian or other meanings of song, like almost all cultural performances, depends to a great extent upon the context. We can't be held responsible for editing or recording a song that is not culturally, or socially acceptable by different groups of people around the world. We will never intentionally record, edit, or conduct voice-over services in such audio material as mentioned in paragraph 11.1.

13.7 We cannot be held responsible for children, older people, vulnerable people or any other people being hurt by listening to our audio files, video or voice-over training at high volume. 

13.8 We cannot be held responsible for the content of external websites that are linked to our website or damage this external content, or systems can cause including but not limited to faulty software, scripts, advice, or any damage caused by incompatibilities, or any financial loss resulting from accessing this information.

13.9 By applying for the voice-over certificate the client confirms that gained access to the training have completed the voice-over training in full, took part in all training-related exercises and activities, passed the exam and made the certificate payment. 

13.9.1 The client also declares that the information provided by the client together with payment (full name and email address) are complete and correct. 

13.9.2 We cannot be held responsible if the client provided the wrong name (spelling error), email (spelling error, or wrong email) or confirmed untruth about their participation in the voice-over training. 

13.9.3 Exam(s) / assessment(s) is included in the KTS voice-over training and doesn't require additional payment.

13.10.1 We cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits, to you howsoever arising as a result of using the Voice-Over Certificate that is issued by us.

13.10.2 We cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits, to you howsoever arising as a result of using any of the Digital Badges issued by us together with accompanying certificates.

13.10.3 We cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits, to you howsoever arising as a result of delay in issuing the Voice-Over Certificate or Digital Badges.

13.11 The additional opportunities listed within the main website and microsites may include external business opportunities, that may, or may not be related to the voice-over business. 13.25 This Voice-Over training is what can be described as work in progress. By buying Voice-Over training from us you agree that some of its parts, modules, activities, games, 3D VR (Virtual Reality) environment, videos may not be fully completed or / and are under development.

13.26 We cannot guarantee that this training will ever be completed. The voice-over industry is changing constantly and we update its modules when required.

13.27 We cannot guarantee that activities in this training that are based on a 3D engine that allows you to use a 3D VR headset, Google VR Services or simply a computer screen will work well on your computer. This largely depends on your internet and computer speed. Virtual Reality requires fast CPU and dedicated VR-ready 3D graphics accelerator. Before purchasing this course, please verify that your hardware complies with the minimum specification for VR Gaming Laptops and PCs.

14. Errors

14.1 This training has been prepared with the greatest possible care and attention to detail. However, it may be that a few errors have escaped our attention. We thank our learners in advance for indicating to us any error or inconsistency, so that we can improve this training for the future benefit of the next generation of voice-over artists. In case, if we have made a mistake, please let us know and we promise to fix it in a timely manner.

14.2 In Voice-Over service (not training) if you have made a mistake in the script, or if words need to be changed for whatever reason after the recording, we may charge a small fee to cover the time taken to put it right.

14.3 In Voice-Over Training if you have made a mistake in the script while applying for the feedback as soon as all assignments will be submitted this is allowed and no correction is required.

14.4 In Voice-Over Training if you have made any mistakes, while training, we may encourage you and motivate you to continue your learning, we all make errors and learn from them. This is part of the learning process and expected difficulty, so don't worry and don't give up. We will never give up on you.


15. Warranty

15.1 Both parties warrant their authority to enter into this Agreement and have obtained all necessary approvals to do so.


16. Indemnity

16.1 The client shall indemnify us against all claims, costs and expenses which we may incur and which arise directly or indirectly from the client’s breach of any of its obligations under these Terms and Conditions.


17. Entire Agreement

17.1 These Terms and Conditions supersede any previous agreements, arrangements, documents or other undertakings either written or oral.


18. Third Party Terms and Conditions

18.1 We use variety of third party services including e.g., Google services therefore by visiting this website you agree with Google Terms and Conditions. The same applies to other third party services, you must accept third party terms and conditions before using it. 


19. Data Mining, Bots, Download

19.1 The automated and/or systematic collection of data from this website and training microsites is prohibited. Downloading, or attempting downloading the whole website, or microsites is prohibited. Using any other software to capture the content of the training except this what is being shared with you on the training is prohibited. 


20. Permissions

20.1 You may request permission to use the copyright materials on this website by writing to info@kamiltomzik.com.


21. Training

21.1 All group and one-to-one sessions may be recorded for quality and training purposes and may be used to promote the Kamil Tomzik Sound website, Talent Development training and other services.

21.2 All work submitted by training participants, whether it is online, in a group or one-to-one setting may be recorded for quality and training purposes and may be used to promote the Kamil Tomzik Sound website, Talent Development training and other services. If you want your work to be kept confidential please refer to paragraph 30.2.

21.3 Every successful voice-over talent upon completion of each module by either live session or e-learning will be given three opportunities (one to receive a freebie that is available in the Freebies Area in the Talent Area, the second to be awarded a certificate / certificates (after passing the exam and making the certificate payment) and those who will buy training with feedback option will also receive feedback on their reading (upon successful submission of assignments in a timely manner). 

21.3.1 Freebie opportunity exists for those, who will enter the right code that is made available during the training online, subscribe with our mailing list or / and access freebie area within the Talent Area.

21.3.2 Certification opportunity exists for those, who will pass the exam at the end of the module, provide their name, email address and secret word during the payment process and pay the certificate fee

21.3.3 When ordering the certificate you must provide a secret word you will be shown on screen after passing the exam. Every module in the KTS voice-over training offers unique certificate and a digital badge that can be used to prove the skills you have gained on this training. 

21.3.4 The certificate must be ordered manually upon completion of the learning module by the client. The certificate order form can be found at the end of the last activity in each module.

21.3.5 To pass you must achieve a 70% score. There is no limit on the number of attempts with the exam, and retakes are allowed. The only limit is that you must pass the exam within 1 year from the date you purchased the course.

21.3.6 The flat fee for the voice-over certificates and digital badges that comes with it for each module is £120 for basic / bronze and standard / silver and £150 for gold / advanced module. Depending on the level of access and when bought seperately Bronze, Silver and Gold badges in Module 1 will require separate payments. The Bronze member will receive one badge, Silver will receive Bronze and Silver badge and Gold member will receive all three badges and acompanying them certificates. After checking the details the voice-over certificate(s) and digital badge(s) will be issued.

21.3.7 The secret word must not be shared or published online. This action may lead to removal from the training and black-listing for current and future courses.

21.3.8 All voice-over certificates and digital badges will be issued within 14 days from the day the certificate payment has been received.

21.4 Each certificated member will gain access to the course and restricted Talent Area depending on the level of access they choose (Standard, or Gold) and the module they have completed (Module 1-8) for one year following purchase (12 consecutive months). After this time the password, and/or microsite address , and/or permission to access the training microsite(s) may change and to access the training the client will have to buy extended access in the following year. The flat fee to access each module is £100 for basic / bronze and standard / silver and £200 for gold / advanced module. All new and existing clients will receive a password and the microsite address by email they provided during the purchase.

21.4.1 The information, training lectures, activities, quizzes and exercises available in each Talent Area are not classified as sensitive data and have an educational character. Information gathered in this password-protected environment are the result of life experience, many years of research and hard work therefore each client is obliged to respect that.

21.4.2 Each talent area is a goldmine of knowledge and has different information, articles, links, resources and exercises typical to the subject and area of knowledge.

21.4.3 Each activity finishes with a quiz, which is an excellent opportunity for you to reinforce learning and to reflect on the information and skills you have learnt. The quiz scores are solely provided to you for practise and to aid in better memory recall. We do not compile, hold, or save the quiz results, however, this functionality can be implemented in the future.

21.4.3 In our training, we use questionnaires, that are used to inform us and the training members about the trends, interests and more. 

21.4.4 We do not store any sensitive information, only the questionnaire results which are being used for marketing purposes, or quality improvement initiatives.

21.4.5 Every client receiving a password will be obliged to keep it secure and refrain from sharing it with anyone, who has not completed a particular module with us. This includes verbal and non-verbal communication, email, social media and any other communication channels.

21.4.6 Every client receiving a password will be obliged not to share any links to any resources, websites, or files or other shared on the Talent Area information with others.

21.4.7 Due to continous training improvement we hold the right to change / update the Training and Training Areas content without warning. This is to deliver the best quality training with up-to-date resources and insight into the voice-over industry. 

21.4.8 We hold the right to change the password to the Talent Areas and the files shared within once in a while to prevent the password from being published online and passed on to users, who are not certified members. 

21.4.9 We hold the right to close the access to the Talent Area, or close access to all training in the future. By that, we are informing you that the access gained to the Talent Area does not offer lifetime access. See 21.4 for more details.

21.5 Feedback is available for certified members, who have made suitable payments. There are three rules regulating the submission of assignments listed below. This is to ensure the quality of the submissions.

21.5.1 Feedback is only available to certified members, who purchased access to the Standard Talent Area with feedback, or Gold Talent Area with feedback and full voice analysis. 

21.5.2 If the training participant will apply for the feedback option will only have four weeks to submit their audio recordings and request feedback. After exceeding this timeframe the client may still get feedback but will be advised to pay an equivalent of 1-hour 1-to-1 session to cover the costs or may choose to not receive feedback at all.

21.5.3 There is a limit of three submissions. After failing, or sending incomplete audio recordings for the fourth time the client may still get feedback but will be advised to pay an equivalent of 1-hour 1-to-1 session to cover the costs, or may choose not to receive feedback at all. 

21.6 Most materials used in the voice-over training including the content of Talent Area have been developed by us, with a few exceptions shared under Creative Commons rights, MIT licence, or any other open licence and with attributes given to their respective owners. 

21.7 We provide hyperlinks to external websites that have educational value to the client with attributes given to their respective owners.

21.8 No physical copies, training materials, publications, certificates, badges, packs or books are supplied to training participants; all materials are delivered in digital format.

21.9 There are no prerequisites to participate in the voice-over training and everyone is welcome.

21.10 We offer a Discovery Session, that can be purchased separately. 

21.10.1 During the Discovery Session you will work with us as a team member trying to resolve the most important issues around your voice-over career and elevate it to the next level. 

21.10.2 You must not record this session and only take notes, as copyrights apply. 

21.10.3 During this session you will ask a series of questions and also answer several questions regarding your plans, business and future career. 

21.10.4 Your answers will allow you to then tailor a precise career strategy and set realistic expectations about what you can reasonably achieve based on your talent, timeframe, constraints and industry requirements.

21.10.5 The Voice-Over Discovery Questionnaire must be completed 7 working days prior to the session.


22. Technical Requirements

22.1 Certificated Voice-Over training and its dedicated Online Server requires a stable high-speed internet connection to operate normally.

22.2 This training course requires a Laptop, or Desktop computer to function properly. Due to the complexity of this training and sophisticated activities and online audio exercises not all parts of the training may work well on mobile devices. This is purely due to the limitation of the e-learning technology, see below for more details on screen adjustment. Many online courses use learning management systems that are mobile-friendly and can present the information in text, video and graphic format, but they offer very limited capabilities to use advanced sound engines and audio processing that is required in this training course. In real-life situations, every voice-over talent operates their DAW software, edits or masters their audio or even creates a meaningful online portfolio using one, or two large screens, not a mobile device. This course normally is delivered in the music studio with access to professional software, equipment and a training room. Many years have been invested to recreate this experience and offer the best possible training you may get. With the use of new technologies, this enhanced training offers voice-over talents around the world an opportunity to learn, collaborate, enjoy and even visit "in person" 3D Studio (Module 2 - Home Studio). For this reason, a laptop or a desktop computer is the best choice and your ultimate business tool.

22.3 Our website and exercises have been designed with scalability in mind (where possible) to provide an optimal user experience across various screen resolutions and devices, but because not all exercises support scalability due to its character and technical limitations, it is recommended to use a laptop, or desktop computer. To further enhance your experience, you can use zoom functionality. You can easily adjust the size of the text and other elements on our training website using standard browser features:

These zoom features provide flexibility, allowing you to customise your viewing experience according to your comfort and specific screen resolution.

22.4 To access the Talent Area, you need to have a free Google Mail (Gmail) email address. You can create your free Gmail email here

22.5 Some of the activities use new active technologies e.g., Google audio libraries, Web Audio, JavaScript and HTML 5 functionalities, therefore require a Google Chrome, Microsoft Edge (or other fully compatible) web browser. Due to known compatibility issues and/or the potential to block active content, some web browsers, such as Brave and AVG Secure Browser, may not function properly with all interactive exercises, hence we do not recommend them for this training course.

22.6 Some of the activities utilises the Web Speech API for speech synthesis. The best web browser that supports most languages, accents and dialects are Google Chrome (5 voices), Microsoft Edge (100+ voices). Due to known compatibility issues and/or the potential to block active content, some web browsers, such as Brave and AVG Secure Browser, may not function properly with these interactive exercises, hence we do not recommend them for this training course.

22.7 For the best experience please use external quality speakers / monitors / headphones connected to the computer. Alternatively, you can use built-in speakers e.g., laptop speakers.

22.8 To take part in training activities and or receive feedback (feedback option) on your reading and accomplish assignments you must have a working microphone (built-in, webcam or external).

22.9 Some activities in this training are based on 3D engine that allows users to use 3D VR headset, Google VR Services, mobile phone or simply a Laptop or Desktop computer. System we use supports all modern browsers, specifically those that support WebGL including: Firefox, Chrome, Edge, Safari. This system requires powerful CPU (processor) with VR-ready graphics card or alternatively fast dedicated Gaming 3D graphics accelerator. No need to be concerned if your computer isn't compatible with the 3D VR world. Everything featured, and more there is also accessible in written and exercise form within the talent area. 


23. Access to Training

23.1 To access the KT Sound training, you are required to provide some limited personal information, such as your email address, and your first and last name. Your name will be used later in the certification process, if you wish to apply for the certificate and a digital badge after completing a particular training module.


23.2 We utilise Google IT solutions to host our online platforms since Google and Google email offers the highest level of security and simplicity. For this reason to access KTS Voice-Over Training you must during a purchase or later provide a free Google Mail (Gmail) email address. You can create your free Gmail email here. This email can be later used to e.g., upload your voice-over for feedback.

23.2 To deliver access, we use a semi-automatic two-stage system that is triggered after each purchase. In case you haven't received our email, please check your spam folder and look for emails from "info@kamiltomzik.com" email address.

23.3 The system we use sends payment confirmation and then we manually send the training access details to an email provided during the payment process, not the PayPal, or Stripe email.

23.4.1 For security reasons we use, however, two-level authorisation including:



23.4.2 The process is straightforward and involves a few steps as listed below. Only when these steps are completed you can gain access to the Talent Area and they are: 



23.5 In case you will log in using a different email (an email address without email activation) or if the activation wasn't completed you will get a message on the screen informing you about limited access: "404. That’s an error. The requested URL was not found on this server. That’s all we know."

23.6 In case you will log in using an email address after full email activation was completed you will be taken to the training website.

23.7 Your Gmail email account, or training module password must not be shared with anyone else to access the training.

23.8 Only one account will be activated per Gmail email, so please choose your email wisely.

23.9 If you won't provide a Gmail email address during the purchase you will be asked to create a free Gmail email and send it to info@kamiltomzik.com. This request must be sent from an email address you provided during the purchase and a new account will be activated for your Gmail email.

23.10 If you are having trouble receiving emails from us please contact us via email describing the nature of the issue and evidence of your purchase (your name, email / PayPal / Stripe email). 

23.11 All Gold Members will get access to the Online Community server via the Gold Talent Area. Some of the Online Community channels require manual activation by training members, this simple process is explained in the relevant modules.

23.12 It may take up to 48 hours before we action your enquiry.


24. Digital Badges

24.1 A digital representation of a skill, learning achievement or experience. Badges can represent competencies and involvements recognised in online or offline life. Each badge is associated with an image and some metadata. The metadata provides information about what the badge represents and the evidence used to support it. 

24.2 Earner it is you, a person who earns a badge by buying the voice-over training module, passes the exam and makes the certificate payment to earn the certificate and a digital badge.

24.3 Issuer it's us, we issue Digital Badges to the Kamil Tomzik Sound community. We are responsible for defining badges, making them available to earners via our microsites and email.

24.4 Displayer is a website, organisation, or person who accesses publicly shared Badges and displays them for badge earners. Earners can display their own badges themselves in their own digital marketing.

24.5 We do not require our clients to submit any type of proof of their training as proof that they (an earner) met the earning criteria for a badge they are applying for. This is accomplished through Voice-Over training completion (including all video training and training activities), which we believe our members have successfully completed.

24.6 Expiration is an expiration date for each badge. Our Badges are not configured to automatically expire, so you don't have to worry about that.

24.7 The Backpack is where you can store and fully interact with any of the Digital Badges you've earned.

24.8 Your Badge confirms your skills and competencies internationally.

24.9 Badges are available to the Kamil Tomzik Sound community of learners. 

24.10 Voice-over badges are issued to all members depending on the level of membership (bronze, silver, gold) within 14 days from making the payment.

24.11 Every voice talent using Standard Kamil Tomzik Sound training can achieve a digital badge after passing the exam and making the certificate payment (standard membership without feedback one bronze badge, with feedback one bronze and silver badge and gold membership bronze, silver and gold badges).

24.11.1 The Bronze Badge (Awareness) is only available in Module 1 - Voice-Over Techniques and confirms you have successfully completed the Introduction to Voice-Over training and obtained a fundamental understanding of facts and ideas related to the subject. The Bronze Badge is awarded to all talents, who joined the KAMIL TOMZIK SOUND training with access to Standard Talent Area without feedback, successfully completed the exam and made the certificate payment. 24.11.2 The Silver Badge (Standard with feedback) is available for all 8 Modules. It confirms you have successfully completed the Voice-Over training together with all activities and exercises per each module. For example, Module 1 confirms that you have watched all training videos, completed activities, received feedback on reading (only if you submit assignments) and by that obtained a fundamental understanding of facts and ideas related to the subject. The Silver Badge is awarded to all talents, who joined the KAMIL TOMZIK SOUND training with access to Standard Talent Area with feedback, successfully completed the exam and made the certificate payment. Please watch all training videos, lectures, and exercises for your own benefit; this knowledge will not only help you pass the exam but will undoubtedly help your voice-over career in the future.

24.11.3 The Gold Badge (Gold, with full feedback and voice analysis) is currently only available in Module 1 - Voice-Over Techniques. It confirms you have successfully completed the Voice-Over training together with all activities and exercises. For example, Module 1 confirms that you have watched all training videos, completed activities, received feedback on reading (only if you submit assignments) and by that obtained a comprehensive knowledge of facts and ideas related to Voice-Over including Finding Your Own Voice, Fundamentals, Pronunciation and The Microphone Techniques and Acting. The Gold Badge is awarded to all talents, who joined the KAMIL TOMZIK SOUND training with access to Gold Talent Area, successfully completed the exam and made the certificate payment. Please watch all training videos, lectures, and exercises for your own benefit; this knowledge will not only help you pass the exam but will undoubtedly help your voice-over career in the future.

24.12 Each badge is registered online and has embedded information, including gained skills and achievements.

24.13 Digital badges are widely used as a verifiable, visual indicator of talent’s knowledge, skills and competencies. They provide an easy and powerful way for voice-over artists to promote their accomplishments through online and social media sites and for others to verify their knowledge, skills and dedication.

24.13.1 Those talents, who successfully pass the exam, make the certificate payment and receive digital badges will also receive access to an accompanying certificate(s) with the QR code.

24.13.2 Those talents, who will successfully accomplish all 8 modules in Silver, or Gold Career Journey will receive respectfully White or Black Belt Badge.

24.13.2.1 The White Belt in Voice-Over is a certification that verifies the best of the industry's greatest skills, as demonstrated via training, exercises, activities, quizzes across all 8 Silver Modules. Each module includes industry-standard abilities and attributes that are essential for voice-over success. The White belt also confirms access to silver resources, publications and a growing number of data.

24.13.2.2 Black Belt in Voice-Over is a certification that verifies excellence and mastery of the industry's greatest skills, as demonstrated via training, exercises, activities, quizzes across all 8 Gold Modules. Each module includes industry-standard abilities and attributes that are essential for voice-over success. The Black Belt also confirms access to gold resources, publications and a growing number of data. 

24.14 The badge is portable and presents voice-over learners with an opportunity to promote their skills.

24.12 Each badge holds information about the skills, character of the badge and other digital information that is embedded into a file. 

24.13 Badges are fully transferrable worldwide and enable voice-over talents to share their verifiable skills and achievements as they earn them.

24.14 With a digital badge, voice-over talents can identify and celebrate talent and growth, making their digital portfolio better.

24.15 Digital badges, together with certificate(s), are the perfect way to start / restart your voice-over career.

24.16 By using Digital Badges and / or other Digital Badge related third party services  you agree with the external provider's Terms and Conditions, Privacy Policy and other regulations imposed by those providers.

24.17 When joining the KAMIL TOMZIK SOUND training course you agree to look in your Junk/Spam folder for emails with the subject line "Congratulations, you received a medal!" This is the email that needs to be transferred to the Inbox folder. It's critical to routinely check the Junk / Spam folder, especially after making the payment for the voice-over training module. After 30 days, most Junk/Spam folders expire.


25. No Refund Policy

25.1 Most online courses sharing digital content in full have a No Refund Policy.

25.1.1 Digital content includes information, training, files and data which are produced and supplied in digital form.

25.2 Due to the nature of the business that is heavily relying on digital content the client, who agrees to enter into the contract by buying our digital content, digital training or other services gives their consent to waive the cooling-off / cancellation period (14-day in the UK). 

25.3 Under those conditions if the client no longer wants digital content shortly after the purchase is not eligible for a refund, meaning there is no refund possible and no monies will be refunded, including but not limited to training, services and certificates. Please plan your purchases wisely.

25.4. This is due to the fact that: 

25.4.1 The client waived the cooling-off / cancellation period (14-day in the UK) to access digital content no later than within two weeks.

25.4.2 There is no right of rejection for digital content, as there is no way to return digital content and there’s no requirement for a consumer to delete content from their device e.g., training pdf files.

25.4.3 Once the client makes the payment the contract will start and our staff will start working to support the client's needs, their development and deliver digital content including communication, a password to access Talent Area, files, know-how, training lectures including the Voice-Over certificates and digital badges that cannot be returned either.

25.4.4 The client has received full access to the digital product, and received this service in full. 

25.5 To recompensate and cover the cost of the client's purchase we will be more than happy to schedule a free 1-to-1 Discovery session. This session will be tailored to the client's needs and provide value to the extend we think is appropriate to match the cost of the client's refund request. If the client feels that the value they have received is not covering the cost of the service we urge the clients to contact us to schedule additional 1-to-1 session. The session will take place only when both parties are available and when this won't clash with other Kamil Tomzik Sound business appointments, but within a reasonable time and without causing significant inconvenience to the client.

25.6 If the client doesn’t give their consent, the cooling-off period applies (14-day in the UK), and lives in the UK the client won’t be able to access our digital content until this period has ended. This has to be communicated by email prior to the purchase by the client with clear approval from our side to ensure that this request will be respected. In this case the client will make direct payment as usual. Please contact us for further details. This will allow a refund within 14-day from the payment date, but as mentioned before the client won’t be able to access our digital content until this period has ended.

25.7 If the client doesn’t give their consent, the cooling-off period applies (14-day in the UK), and lives in a different time zone than the UK, or has different expectations regarding cooling-off period (e.g., 30, or 90 days) and give additional time to ensure that this request will be respected, the client won’t be able to access our digital content until this period has ended. This has to be communicated by email prior to the purchase by the client with clear approval from our side to ensure that this request will be respected. In this case the client will make direct payment without using our automated payment system. Please contact us for further details. This will allow a refund within 14-day from the payment date, but as mentioned before the client won’t be able to access our digital content until this period has ended.

25.8 To fully satisfy the "No Refund Policy" as well as other regulations included within the Terms and Conditions and protect the clients and prevent unintentional and unplanned purchases we have added the "I have read and agree to the Terms and Conditions" clause with a tick box that has to be manually chosen at the payment form (PayPal payment form). Payment on the original website isn't possible unless the Terms and Conditions box is ticked, other words the client can't purchase anything from us without agreeing with our Terms and Conditions including this "No Refund Policy". While some landing pages might lack a checkbox, the details regarding Terms & Conditions or Disclaimer are still apparent.

25.9 At this stage, we would like to remind anyone reading this document that as of 1.4 paragraph, any attempts to re-sale this Voice-Over training to attempt to receive their training costs back, make additional income or for any other reason will result in severe consequences. It's the client's responsibility to make sure that the work they produce is in line with copyright law and the client is solely responsible for using only royalty-free scripts, sound effects and music in their productions, including exercises, demos, voice-over published for feedback, reels and others. In this situation, we are unable to accept any liability for a client's actions. 

26.20 The Voice-Over Business Simulator game used in KT Sound training is there solely for entertainment and fun purposes. It is not a real business simulator and does not provide an accurate reflection of the voice-over industry or its complexities. The game's mechanics, scenarios, and outcomes are purely for enjoyment and should not be considered as a representation of real-world voice-over business operations or career prospects. 26.21 This training utilises advanced and experimental code, posing potential challenges associated with engaging in training exercises. You should be aware that the utilisation of code used in training exercises may demand significant computer resources, and web browsers may experience instability or crashes during the execution of the code. The buddy may also offer encouragement and knowledge. 

29.8.2 Only Gold Talent Area members have access to the Online Community server and Buddy System. 

29.8.3 New or existing Gold members can request a buddy (subject to availability).

29.8.4 Gold Talent Area members can join in the Buddy System and request a buddy, or offer their services as a buddy and benefit from discounts, or / and discounted access to certain modules (depending on the offer).

29.8.5 A buddy shall not be required to assume any of the following roles:

29.8.5.1 Paid Staff: Someone, who is paid to support you.

29.8.5.2 Mentor: Someone, typically more experienced, who is involved with the all-around development of an individual (personal and professional).

29.8.5.16 Manager: Someone responsible for the new employee's job performance. 

29.8.5.17 Business Owner: Someone, who owns www.kamiltomziksound.com, www.kamiltomzik.com, and www.thevoiceacting.com training and its content.

29.8.6 To become a buddy you must meet the following criteria:

29.8.6.1 Be honest and genuine.

29.8.6.2 Create a profile within our Online Community.

29.8.6.3 Be active, take part in discussions and achieve level 5 on our Online Server (Go to TRAINING SUPPORT->#rank and level channel and type in "!rank" and press Enter to see your level). You can level up by participating in discussions on our online server. 

29.8.6.4 Have genuine interest in helping others and support to other learners in the voice-over online platform. Please refer to the "Key characteristics of a Buddy" that you will find at the top of this page. Generally, we accept everyone to the Buddy System, except those, who don't want to help other talents, or join the programme.

29.8.6.5 Take the Buddy Test (available in the Gold Talent Area -> How-To under "How To Become a Buddy"), if successful you may gain access to the Module 5 - Professional Development.

29.8.6.6 Each Buddy will be assigned a new Buddy Role and their name will be listed under: "DIGITAL VOICE-OVER BUDDY" category, and their name will change its colour to bright green. High visibility on the online platform will help other members to identify Buddies on the system.

29.8.6.7 Don't forget to send an email to: info@kamiltomzik.com informing that you have passed the test and would like to become a Digital Buddy!

29.8.6.8 As a Digital Buddy you qualify for 50% discount on Module 5 - Professional Development.


30. Online Community Subscription System

30.1 With subscription, you can access multiple plans called tiers within the server that will enable you to access VIP roles, channels and / or services.

30.2 Each tier has a price and one or multiple roles that are given when you subscribe. You don't have to buy multiple tiers, because each of the higher tiers includes previous tiers. 

30.3 When you subscribe to one of tier, you'll be billed the tier price each month at the same date you subscribed to. Example: if you subscribed the 04/10/21 your subscription will renew the 05/10/21 etc... until you decide to cancel your subscription.

30.4 You can cancel your subscription at any time from your "subscriptions management" page. When you cancel your subscription, it will not renew but you'll still have your benefits active until you've consumed the remaining days you paid for.

30.5 The subscription system we use doesn't support refunds therefore no refund is possible. In this case external subscription services may have their own policy and their terms and conditions also apply. Please plan your subscription purchases wisely.

30.6 The payment is automatically deducted from the amount of the membership cost using the payment method you used the first time.

30.7 For now, you will only be able to subscribe by debit / credit card. The subscription system we use partners with Stripe to support a wide variety of debit / credit cards and to ensure your debit / credit card data is safe.

30.8 We do not have access to or keep any credit card information or your bank account information. We use Stripe, an industry leader on payment processing to handle the credit card payments. Stripe keeps the credit card information safe and will use it to handle the renewing subscription payments.

30.9 We pledge to support VIP channels and their members solely to the extent that our personnel capability allows.


31. Leaving Voice-Over training after the purchase

31.1 When thinking of leaving Voice-Over Training just to let you know that we are sorry to hear that Voice-Over isn't for you. It's not possible to get a refund on digital goods as you already have been granted access to the digital goods for 12 consecutive months (as per 21.4 and 25.3 paragraphs of this document) and you agreed to this when purchasing this Voice-Over training.

31.2 Cancelling also depends on which service you’d like to cancel, you can cancel additional subscriptions within our Online Community Platform if you have choosen to pay additional monthly subscription with external service providers (e.g., services enabling access to the VIP channels, that can be purchased seperatelly). In this case external services may have their own cancelling policy where their terms and conditions also apply.

32.5. Never post, or ask other members to post links to your Voice-Over Training. Never post, or send links to training modules, microsites, activities, exercises, or resources in this server, any other group, social media, email and internet as such. This content is not free, protected by copyrights and different users have a different level of access.

32.6. Do not Spam or Publish any Ads. We are here to Learn Together. No Promotions or Spamming Online Community members. Self-promotion (except self-promotion channel), spam and irrelevant links aren't allowed.

32.7. Do not post any Copyright-infringing materials. We respect copyrights and copyrighted materials, don't share books, music, films or other copyright-infringing materials.

32.8. Do not post, or ask for any Personal Information. Under (GDPR) in Europe The General Data Protection Regulation you should not publish any personal information in this server. This law requires voice-over training members from outside the EU to comply as well.

32.9. Jobs / Casting / Voice Acting Opportunities. You are welcome to publish jobs/casting opportunities, but only in the Online Community, not in the comments.

32.10. Volunteering / Work Experience Opportunities. You are welcome to publish volunteering/free/work for experience opportunities but only in the Online Community, not in the comments.


33. Marketing

33.1 Our website contains affiliate marketing links to support the Kamil Tomzik Sound website.

33.2 We reserve the right to use your voice, assignments and any communication including the e-mail you send to us as a testimonial. If you do not want your e-mail, voice, feedback on reading or assignments to be used in such a manner, please mark them confidential in the subject area.

33.3 We sometimes record our live presentations, sessions, meetings, events, recruitment events, promotional events, marketing stunts or voice work-outs and because they contain a quality learning materials we reserve the right to use these recordings or videos as a promotional tool in our online marketing. By attending our live events you agree with this. If you do not want to appear in the video (screen capture), photo (image) or audio recording (your voice), or do not want your image or name being used in such a manner, please let us know about this in the email at least three days before the session takes place and mark this email as confidential in the subject area.

33.4 If you have been recorded during one of the live event and you no longer agree with your image being used on our marketing materials, please let us know. We will remove, or replace the video, voice or image but be advised that this may take some time. Please be patient while we will work on this change.

33.5 By taking part in our surveys you agree that your email and information provided by you will be stored and processed by our systems and third parties servers. In some cases you can edit your survey response if you wish to, some of them don't expire.


34. Whistle Blowing, Reporting and Speaking Up

34.1 We encourage all training members to raise issues without fear of retaliation, we treat all reports seriously and investigate them thoroughly.

34.2 While interacting with other members you should report suspected unethical, illegal, or suspicious behaviour immediately. We do not tolerate breaking these terms and conditions or retaliation against anyone who makes a report in a good faith.

34.3 Please report any unethical, illegal, or suspicious behaviour including gifts, scam offers, financial offers, bribe or kickback from any internal, external, or third-party individual, company, voice-over agency, recruiters or organisation in return for access to KTS voice-over training, or access to any KTS training content including text, files, articles, exercises, activities, sourcecode, know-how, videos and anything that can be clasified as part of the training.

34.4 KTS learners must never attempt to influence the judgment or behaviour of a KTS staff member in a position of trust by paying a bribe or kickback.

34.5 Where you have been found to have committed fraud or been involved in bribery, working with people, who are breaking the law (including copyright law) you put yourself at risk and this may also lead to removal from the training course, or legal action depending on seriousness.

34.6 We prohibit the giving and receiving of hospitality / business gifts and similar where the intention in doing so is to receive or confer an advantage in return for giving or receiving the hospitality/business gift or similar.


35. Scams

35.1 There are number of scamers currently working hard to locate people's IP address in order to lock their computer, trick them into buying discounted services or gain access to their data. These scams are often very sophisticated and people, who conduct them are joining variety of online communities just to share their scam "hook". These scams are listed on websites like https://www.scam-detector.com, https://www.scamadviser.com, https://www.islegitsite.com and https://www.scamfoo.com. There is no website listing scammers, they change their identity daily. We encourage you to stay safe online.

35.2 Never accept any gifts, offers, or click on links from anyone you don't know.

35.3 Never communicate with people, who will ask for you for your personal information or ask you to make a payment on our behalf.

35.4 Report all members who present unethical, illegal, or suspicious behaviour immediately.

36.5 All scammers will be reported to relevant bodies.


36. Protection of KTS’s Reputation

36.1 All members should always protect KTS’s reputation.

36.2 All members should ensure compliance with the Terms and Conditions.

36.3 All members should refrain from making any comments that may harm KTS’s voice-over training reputation on social media, or any other public platform before contacting us. Contact us first, we will try to resolve the issues for you. As any business online we need good feedback and happy customers.


37. Conflict of interest

37.1 Conflict of interest is a common issue in the workplace, both online and offline. A conflict of interest occurs when an individual’s personal interests, e.g., family, friendships from other employment, financial, or social background could compromise their his or her judgment, business decisions, or actions in the workplace. At KT Sound, we take conflicts of interest very seriously and regulate access to the KT Sound voice-over training.

37.2 In order to avoid a conflict of interest, no staff member or volunteer who works, or volunteers with KT Sound staff, or is a coworker in another line of work outside of KT Sound where KT Sound staff works together with their immediate family (parents, siblings, spouse, and children) is permitted to access, or participate in the KT Sound voice-over training.

37.3 When this is discovered, no access will be given and money will be refunded. This will also include a £50 refund charge per each module. Combo pack discount price won't be considered and all modules will incur a refund price separately. 

37.4 If the staff member or volunteer who works, or volunteers with KT Sound staff outside the KT Sound buys access to the KT Sound voice-over training under another name and this will be discovered, this will be treated as an intentional violation of these terms and conditions and will result with removing access to the training and no monies will be refunded. This will also be considered as acting with the intention of creating an unfair competition. Please see 5. Unfair competition paragraph for more details.

37.5 At KT Sound we don't allow our friends, or work colleagues from other streams of income and their immediate families to affect our business. If you are a member of any of the aforementioned groups, you may be in violation of these terms and conditions. In this situation, kindly refrain from attempting to participate in the KT Sound voice-over training or contacting our employees about the KT Sound training. All information regarding the KT Sound training is available on KT Sound website.


38. A.I. Systems

38.1 Our training and its content is copyrighted and registered online and users are not permitted to input KT Sound training content, source code, or any of its elements into the A.I. systems for the purpose of training A.I. systems, improvement, resale, or any other reason. 

38.2 This policy is in place to protect individuals who are working or experimenting with A.I. systems using different content and prompts from possible violations and copyright lawsuits from our side. 

38.3 It is also to protect the KT Sound training content from copyright violation and fraud. We appreciate your understanding and co-operation in adhering to this policy, as it helps us provide a safe and responsible experience for all users. 


39. Diversity, Equality and Inclusion

39.1 KTS was started on the belief that this voice-over training is for everyone, who wishes to learn more about voice-over, or voice acting.

40. Climate Emergency

40.1 Please consider the environment before printing our emails and files stored on our Website, Servers and Talent Areas.

40.2 When accessing this training consider using a laptop computer. Laptop computers consume up to 80 percent less electricity than high performance desktop computers.

41.3 We confirm that the majority of the content within our training course has been developed by us. Nevertheless, certain elements and content are utilised under various open-source licences, and these remain the property of their respective creators. Any sources of content, source code, ideas, expertise, know-how, information, photographs, audio, and music that were not originated by us and are legally obligated to be credited are appropriately referenced at the bottom of each training page, within its source code, or both. 

41.4 We uphold the highest ethical standards in education and training, which is reflected in our training course. Our Terms and Conditions emphasise fairness, respect, and integrity in all interactions and practices within our training programme.

41.5 We are transparent in our communication with clients regarding our Terms and Conditions and, for this reason, the Terms and Conditions have to be marked as read before the purchase. We believe that transparency builds trust and fosters a positive learning environment.

41.6 We strive to make our training programme accessible to all participants, including those with disabilities. We use plain language and strive to explain everything clearly to meet the diverse needs of our learners.

42.2 To be accepted into our affiliate programme, it is essential to comply with both the terms and conditions set forth by the affiliate network you choose to join, as well as our specific affiliate programme requirements.

42.2.1. Active Promotion: Affiliates are expected to actively promote our products or services through various channels, such as websites, blogs, social media, and email marketing.

42.2.2. Content Quality: Ensure that your promotional content is of high quality, accurate, and aligns with our brand values. Misleading marketing, or inappropriate content is not allowed. We do not collaborate with affiliates who have incomplete websites or outdated blogs.

42.2.3. Ethical Marketing: Conduct ethical marketing practices and avoid any form of spamming, phishing, scams, deceptive advertising, or unethical tactics that could harm our brand reputation. We check affiliate websites before allowing them to join, and if your website is considered dangerous and is blocked by our antivirus, you won't be allowed to join.

42.2.4. Compliance with Policies: Adhere to all applicable laws and regulations, including but not limited to privacy laws, national guidelines, and any other relevant regulations in your region.

42.2.5. No Self-Referrals: Affiliates are not allowed to earn commissions on their own purchases or create fake referrals. This includes using multiple accounts to generate commissions.

42.2.6. No misleading advertisement: Do not use our brand name, logo, or trademark in a way that may confuse or mislead customers. Respect our intellectual property rights.

42.2.7. No Content Infringement: Do not use our training content for your marketing. Use only marketing available via the affiliate network. Don't share links and training materials with anyone. Respect our intellectual property rights.

43.1.2 “Force Majeure” means any event which is beyond the reasonable control of either party which shall include, without limitation to acts of God, flood, governmental actions, fire, earthquake, death, illness or other capacity certified by a properly qualified medical practitioner, war or national emergency, acts of terrorism, protests, riot, civil commotion, explosion, extreme weather conditions, flood, revolution, insurrection, epidemic, pandemic, lock‐outs, strikes or other labour disputes or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, telecommunication breakdown or power outage;

43.1.3 “Terms and Conditions” means the terms and conditions upon which the booking for Kamil Tomzik Sound services is made and which is set out in this document;

43.1.4 “Kamil Tomzik”, "Kamil Tomzik Sound" “us”, ”our” or “we”, "KTS", "KT Sound" and "KAMIL TOMZIK SOUND" means www.kamiltomziksound.com, www.kamiltomzik.com, www.voiceactingexpert.com, and www.thevoiceacting.com which are part of Creative Solutions Scotland.
